Legal Question in Real Estate Law in India
Niece claiming property
We are three sisters whose brother
and his wife have passed away. He
lived in the house built by our
parents with his wife and daughter.
Now the daughter claims the house
(and property) belongs to her. We
have no documents or copies such as
sale deed, title, katha, etc. How do
we know on what grounds this niece
is claiming the property? Do we
make a claim for our share through a
lawyer to oblige her to disclose
whatever documents she is holding?
How do we prevent her from selling
the house and property?

You can all the copies by applying in the Revenue and Registration offices.
In impending litigation, it is always appropriate to get yourself informed of the facts before taking any stand.

Re: Niece claiming property
Few things shall be looked into before proceeding for a litigation:
1. Title of the property
2. How the property passed on to the deceased brother.
3. Family tree for your parents
Yes, there is likelyhood of your share in the property as the property belonged to your father.
