Non Occupany charges

I have a flat in Mumbai, India. We being out of Mumbai, the flat is vacant. I have neither let it out nor given on rent. However, for some days in a month my niece son comes from Delhi and stays in our flat. I do not charge him for amenities, maintenance etc. The Housing Society says it will charge penalty and non occupancy charges. Kindly inform whether mere making my relative stay in our flat free of any charge amounts to non occupancy.

You may send your one of the family members to stay in the said flat and intimate the society that the flat is occupant.

You may occupy the flat and inform the society that one of your family members will be staying there.

Demand of the society is not tenable.

Try to explain the office bearer of the society. Else, you need to approach appropriate forum against the demand.
