Legal Question in Real Estate Law in India
I am an NRI and I have couple of questions related to power of attorney which will be used to file a partition suit in India. The questions are
- can it be on a plain paper OR it has to be on Indian Stamped paper
AND
and get is notarized by a local notary
OR
- have to get it attested by the Indian Consulate in Washington
Any clarification in the matter is appreciated.
Thanks

you can get it done on either stamped paper but if on plain paper you have to pay teh stamp duty in india you can get it notorized or sworn before the indian counsulate both are valid
you may get the same executed on a plain paper and it needs to be either notarized or you may also get the same attested by the indian consultate.
After notarization through the Emessay of India, against back home in India the PoA has to be embossed in the office of State Financial Commissioner designated for the purpose.
