Legal Question in Real Estate Law in India
I am an NRI in UAE for past many years. Originally I am from UP in India. Before my marriage in 2008, my mother gave me a house (which was on her name) to me, it was a very old house which I rebuild on my own (A three bedroom house from scratch). I just have a 'Bainama' of this property and my sister also has 25% share in same property given by my mother when my sister was not married but now she is married. My question is that just Bainama is enough for ownership claim or a Registary is compulsary ? what may go wrong in future when I return to India if we do not register this property.

bainama is not sufficient... as you said the property is in ur mothers name so if she makes a gift deed its better through which you can get you name changed in all the govt records and become the real owner of the same... if you need any further help in regards contact me at [email protected]
Ownership or title passes only by a registered conveyance like sale deed, gift deed etc.
