Legal Question in Real Estate Law in India
ownership of property
The property stands mutated in my name in the govt. records. Is that a sufficient proof of my ownership?THE title deed is challenged in a suit by my father who claim himself as the owner by claiming that it was he who spent 4 the acquisition of the suit property from his own exclusive resources.

Re: ownership of property
the mutation is only a 'presumptive' evidence which can be rebutted by leading evidence about sale consideration etc.
the mutation in govt records is not CONCLUSIVE proof of ownership. it is only prima facie.
if your father bought the properpty, he may be entitled to claim a declaration about his ownership.
Re: ownership of property
despite the fact the property is mutated in your name still your father can dispute the fact of ownership by adducing evidence related to payment of consideration amount or govt. charges. till the court doesnt issue a declaration of ownership, u not an owner.
Re: ownership of property
Entries in the Revenue Records are not the proof ownership. Those entries are mainly for collection of revenue by the Govt.
