Legal Question in Real Estate Law in India
Pagadi
HI,
I own a pagadi commercial place of around 200 sq ft where I have not paid maintenance for 8 years.
The person who handles all of this has charged interest on Interest every year for eg if the maintenance for a particular year was 10000 and if i have not paid it than he has charged 15 % on that making it to 11500 and next year he has charged again interest on 11,500 +Rent of that year + 15 %
I spoke with him regarding this and he said that this is valid and he is not ready to accept part payment also as he is saying that you have not operated the premises for more than 3 yrs and not paid rent and your tenancy might be revoked .
He is not ready to negotiate also ; nor is he ready to show the books of accounts and he is saying that he has sent a legal notice for which he is charging 1500 more which I never received as the place was closed for personal reason.
I have now given the place on rent without his knowledge .
I want to settle this but want him to offer some concessions . What options i have as i dont want to waste time on legal matters but want to tell him that I know what he is doing is wrong . Kindly suggest options and If am right that what he is doing is wrong.

If owner is not ready to negotiate, you have no other option but to engage in legal matters.
Re: Pagadi
You may need to settle on mutually acceptable terms. You may not be allowed to impose your own terms. If you fail to negotiate, the legal process may follow.
