during the pendancy of a stay can property rights be relinquished in favour of another person with the proviso that any order passed due to the stay will be fully honoured by the person in whosr favour the property is being relinquished

its better if the person relinquishes his share in the court where case is pending.

When there is any matter pending in the court of law on the same cause action, any transfer, surrender, assignment relating thereto will not come into effect unless court shall allow. In your case leave may be obtained from court with prior permission.
