Legal Question in Real Estate Law in India
One Plot along with the building thereon is in the name of 2 Persons say x and y. There has been oral partition between the family and the said plot and building came to the possession of x and to other person say z. The ground floor came to the posession of x and first floor and second floor and terrace alongwith the FSI came to the posession of z. Now z wants to get his name on the said property and also x and z wants to specify there portion of property on property card. The property is situated at Taluka Place where Nagarpalika is there. Hence my questions are:
(1) How the name of y can be deleted from the Property Card and name of z can be added?
(3) How much stamp duty has to paid? is it to be paid one time or more time?
(4) What kind of execution of deeds should be done?
(5) How to specify the protions of property of z and z on property card or how to define it?

You have to execute and register a partition deed earmarking which portion goes to whom. Thereafter, you can submit the partition deed with muncipal authorities.
