Legal Question in Real Estate Law in India
Posession Letter - Gujarat Property Law
I own flat in cooperative housing society. I am having
1) Allotment Letter from cooperative housing society
2) Share Certificate from cooperative housing society
3) Complete Payment receipts from developers
4) My name is endorsed in Nagarpalika against said property
5) My name is endorsed in electricity bill
Note: I got this flat as direct allotment/ first member in cooperative housing society.
My question is whether I also require possession letter to prove my ownership of flat.
If yes then it should be on letter head of Builder or letter head of cooperative housing society?
Note: Builder is not approachable.

well the papers you have been handed are sufficient to prove the ownership
Re: Posession Letter - Gujarat Property Law
In respect of flat in co-operative society, ownership or title of entire property, including flat you are refereeing to, vests with the society.
For a valid right of use, occupation and enjoyment of the flat, you need to acquire such rights by duly stamped and registered agreement.

Possession letter will merely prove that actual physical possession was also handed over to you but it has nothing to do with your ownership. The papersare sufficient for your ownership.
