Legal Question in Real Estate Law in India

Possession Letter

I have bought a pent house in a newly constructed building, but my builder is not giving the original possession letter to me, he says he can only give the duplicate one.

kindly tell me about the requirement and repurcussions of not having the original possession letter.

Re: Possession Letter

Congratulations on your new acquisition.

Your facts are not clear for providing you appropriate guidance. If there are several flats in a building with only one original possession letter with the builder, you may accept the duplicate letter alongwith possession of your flat.

Re: Possession Letter

It depends on from whom to whom. If it is a letter from you confirming receipt of possession, then original will be with the builder.

Simple way out would be to print two copies of such letter and put signatures of both parties on both sets. This will make both the sets original.

Re: Possession Letter

in case you have lost the original possession letter, u may lodge an f.i.r to that effect and ask the builder to supply you the duplicate copy. in case he doesnt do that, you may file a civil suit directing him to supply the copy of possession letter.
