Right to prevent MTNL staff in a Mumbai Co-op Hsg. Society
Sir,
I am a tenet leaving in a Flat in
Navi Mumbai in a Co-op Housing
Society under Mumbai Hsg. Society
Act. As there was not landline in
the flat, I had applied for an MTNL
telephone connection in my name
with a NoC from the flat owner who
is a regular member of the Co-Op
Hsg. Society. MTNL has a digital
exchange in the Society premises,
When the MTNL staff came to
provide connection, the Manager of
the Society denied access to the
society premises to MTNL staff for
providing connection citing that '' it
was unanimously decided in last
AGM to have new telephone
connections in the name of the
''owner'' only. Even though the
owner has No objection to my
availing the MTNL connection in my
name, the society is preventing
this. I would like to know is the
society has jurisdiction in the choice
of billing by a member? If no, than
what course of action can be taken
to stop the manager from
preventing access to MTNL staff to
provide connectivity.

Action of society is not legal.
Approach the DDR or Court for redressal.

The action taken by the society is ILLEGAL.
You may consult a local lawyer and approach the DDR court.

You may need to make a representation to the office of RCS against AGM decision of the Society.
