Legal Question in Real Estate Law in India
Prior pending dues against first party
I purchase one house 9 months back and first party did not paid electricity bill and sold me house . The party never told me about pending electricity bill in written or orally .They sold me house and now i got notice from electricity board for paying the bill amount after 8 months . The bill amount was Rs 27083/- which is consumed by first party. Eventhough they had not legal water and shewage connection but they got No Objection Certificate(NOC) from corporation without legal water/Shewage connection and heavey electric bill pending. Please advice me what kind of legal action can taken against first party to refund electric bill amount.

You may show NOC to absolve yourself of dues,if they coerce you to pay, claim the same from earlier owner through suit and also file a criminal case for fraud.

Under the clause of Indemnity, the Sellor is legally bound to the pay the dues till the sale deed, or else you can pay the same to avoid dis-connection and take legal recourse against the Sellor.
