Legal Question in Real Estate Law in India
Hi, I am in process of buying a shop. The shop is located on the ground floor facing road of a housing society. All the papers are clear from the owner. I have a query about NOC form society.
As per the owner's discussion with the society chairman, society has not issued any share certificate to the shop owners and hence they are not the members of the society. So no NOC required for sale of shop. Is it true? Society collects some maintenance from shop owner so will issue No dues certificate for the concerned shop. Are there any hidden concerns in this deal from Society point of view.
Thanks....

You are buying shop for some consideration and asking question on this forum , Engage a lawyer to guide you . Please check Sanjay Kalra and Associates on the internet to know more about our law firm and the legal services we are rendering for our clients from all over the World.
A Housing Society is made for all the purchasers of flats/shops in a building or complex.
Check with the office of co-operative registrar about names of members, particularly which member is shown as purchaser of that particular shop and then decide further line of action.
