Property

My father went missing since 2002,

an FIR was raised in the same year

and we have searched all the

possible areas/cities with not much

luck. He is a ex employee of

Syndicate bank. We have a house

on his name and the papers

relating to the house are with the

bank. What is the procedure to get

the papers released from the bank

and also convert the property in the

name of me/mother.

You may file a suit for declaration about his "civil death" and claiming rights of inheirtance being his legal heir. If the court grants a decree in your favour, you may approach the bank.

Firstly you are supposed to mention why the papers are with the bank.You may file a civil suit for inheritance and to serach for your father extensively contact a NGO,address given below, which will more than 90% try to locate your father.You may try to approach them: wwww.unknownbodies.com/www.helplineunknownbodies.com

when a period of seven years is passed since the day the person is reportedly missing, he is presumed not alive. in that situation, the same procedure would follow as if the person is not alive. in case you have any hurdle in getting the property mutated in the name of your mother, you may seek a declaration/succession from the court.
