I had filed a suit agianst the builder wherein as per the cosent terms the builder was suppose to give me my flat and occupancy certificate and the decree was passed in terms of the consent terms filed now after 17 years i ve filed contempt notice of motion for not fulfilling the terms even after continous communication with builder for last 17 years.what judgements are available to sustain my notice of motion and can the builder be punished for not fullfilling th eterms and under which act.

The Petition/Application is filed under Contempt of Court Act, it has to be seen, under what section that petition has been filed. It is punishable with imprisonment and fine.

It is filed under Contempt of Court Act and very much punishable with impriosnment with fine.

Contempt proceedings may not be maintainable against non-satisfaction of a decree.

Consult with details.After decree is passed then execution is to be filed and no case of contempt is made out.
