Legal Question in Real Estate Law in India

���I have an old property jointly owned by me and my brother. Builder agreed to buy my brother share and do the sale deed for his 1/2 share. After this he will do a collabration agreement and partition deed with me whereby he will make new building in which i will get ground and first floor and he will take the 2 top floors. In partition deed it Will be mentioned that first i will get possesion and only after that he will give possesion of his floors. Right now the builder proposes to sign agreement to sell with my brother and an MOU with me. Please suggest is this way right. Thanks.

better retain a lawyer and get all the documents executed through him in order to avoid any fraud at the later stage.
