Legal Question in Real Estate Law in India
There is a property which is on my mother's mother name and we have used that property for education loan and kept it as collateral in a bank.Now my mother's brother is asking for that property and sending a court notice to us.My mother's mother has signed as guaranteer for the bank loan we took and kept that property as collateral.So what should we do..do my mother have a right to claim it or if get a court notice on that collateral,what will bank do

No ur mothers brother do not have any right in the property....
your mother has full right to claim over the said property... for any further doubts you can mail me at [email protected]
After a property is mortgaged, till loan is repaid and mortgage is released, it will be for the bank to decide what to do about such mortgage.
