Legal Question in Real Estate Law in India
We have a property which is mutually divided among the owners but no partition deed made for the same. Now, if partition deed is filed then how the partition will take place. Will the partition be based on current valuation or based on measurements? We donot want to go for mutual partition because rest of the owners are not of co-operative nature. If we go for partition by law then what would be the result?
N.B.: If the property is divided into three parts then the middle portion will not be in a position to stay as far as ventilation is concerned. Please advise.
