Legal Question in Real Estate Law in India
The property was purchased by father but in the name of his son in 1974 who had no means of income then 4 being a student himself . The property throughout these years remained in possession of parents. Is the perpetual- lease in the name of son attracts the provisions of benami act 1988? Quote a law case.How 2 avoid litigation the property is already in possession of real owner i.e. father.

no it does not attract. u r the real owner and it is persumed that property has been gifted by your father to you.
