Legal Question in Real Estate Law in India
The Property value is Rs. 40 Lakhs. Such property is redeveloped construction. The Property was in the name of widow female. She has Three Sons. One of the son fraudulently take signature of his mother and two brothers on the papers of property, saying that signature is taken for procedure for redevelopment construction and acquire the property in his own name. The language of the papers was in English Language and none of them doesn't know English Language.
Can they file the case? and any remedy available for fraudulently taking signature on the paper?

Yes, they may file a civil case in local courts seeking appropriate declaration; as well as a criminal case of cheating.
Person deceived can file appropriate suit claiming all the reliefs like declaration that said document is not binding on them as also injunction restraining said one of the sons as also developer etc.
