Legal Question in Real Estate Law in India

Property Transfer

1. I have purchased a 100 years old house property in Ankleshwar city of Gujarat State in 2001.The total land area of 1000 sq ft of this house property is a combination of four city survey numbers. For examples A,B,C and D.

2. During the dealing time I, ( Purchaser party ) and the old owner ( seller party ) had forgotten to verify the city survey records with the physical possession area of 1000 sq ft of this House property. As per city survey records city survey numbers A,B, and C are in the names of old owner (Sellers ) and C.S. No. D is in the name of other persons by mistakes.

3. The property as mentioned in C. S. No . D is not in my name. The joint owners of this C.S. no. D are dead. I dont know about the inheriting persons of this property .

4. On the contrary to the point No. 4 as mentioned above, the entire property was in the name old owner (seller ). Later the property was transferred in my name by the municipal authorities.

My query is as below.

Whether the mistake/error on the part of City Survey office can be rectified ?

The old owners ( Sellers ) of this property has expressed their willingness to help me in solving the problem by making an affidavit in my favour.

.
