Legal Question in Real Estate Law in India
I had purchased a flat in Ahmadabad, Thaltej area in July 2005 with an built up area of 180 sq. yards under Uday Co-operative housing society. We were allotted share certificate dated back of the year 2000 on account of which we did not pay any stamp duty as intimated by the builder. The entire members of Shri ratna apartments under the legal ownership of Uday Cooperative Housing society did not pay any stamp duty. At that point stamp duty payable was Rs. 43,000/- However, effective from 1/4/2011, Govt. of Gujarat revised jantri rates 6 to 10 times. Earlier before 31.3.2011, the registration cost was Rs. 75,000/-; now as per the revised estimates, we have now to shell out around Rs. 2,25,000 for registration.
Could u kindly let us know how and why this new rates are applicable to our flats which were allotted to us in July 2005 and have taken possession in the same month? What are the implications of non-registration of flats even if one does not sell the flat in long run?
