Legal Question in Real Estate Law in India
I Have purchased a flat in resale in a month of July in Badlapur, Dist.Thane, state. Maharashtra. The society is registered under the cooperative societies act but not yet handed over by the builder so all the legal documents like NOC is signed by the builder.The care taking committee is formed to look after the society.
An AGM was held in month of august and I had given a letter 3 days before the meeting regarding the repairing of steps in the staircase and leakage in the room from ceiling. In meeting when the issues of maintainance came for discussions i raised the issues mentioned in a letter but I was told by the committee that I dont have right to talk in meetig .The reason gien was I am not a member of the society since share certificates are not yet issued to me.I told them that I am paying maintainance I was told that Since society is not yet handed over by the builder we are not taking a maintainance but it is only the subscription.When I asked them to how many members share certitificates has been issued Iwas told that i dont have right to ask this as well. Now if issuance of share certificates takes 5 to 6 months then society might go on saying same thing that I am not a member of the society. How can I tackle this situation.
