Legal Question in Real Estate Law in India

I have purchased a flat in thane but the problem is that i am not getting the reuired amount of loan... the agreement is still not done but i have given the money as DD for stampduty and registration to the concerned government department now my question is that i want to cancel the deal so can i get my money refund which i paid for stampduty and registration as the agreement is still not signed... please advise me the procedure to get the money back

Dear Sir / Madam,

The Stamp Duty and registration is done only after the full purchase consideration for the property is paid and the Society has registered the transfer.

This is done since the Stamp Duty once paid is not refundable under any circumstances.

Stamp Duty paid, and if the document is not used, can be refunded, provided the refund is sought within 6 months.
