Query on AIR 1989 KERALA 317

According 2 the prohbition of benami transation act 1989, the benamidar the possession of the property before sec. 4 of the act b applied( AIR 1989 KERALA 317) My question is that is it necessary that the benamidar b in possession on the date of the suit? The above leading case is not clear on this point.l
