This is in continuation to my prev query ...

A Will has 4 beneficiaries with 25% share each clearly mentioned and if a probate is done on any 1 beneficiary does that mean the other 3 beneficiaries forfeit their share towards the property by giving noc .

My grandfather dies and left behind a property

I am being told that probate done on one name ie wife of the deceased is simpler and takes less time however a probate done on all 4 name can take a min of 2-3 years atleast

Now My question is

a) that my grandfather has given life interest of the property exclusively to his wife ie the property will belong to my wife entirely however has also mentioned that if my granmother sells the property than entire consideration would be given in the ration of 25 % each

In this case i am being told that probate done in my grandmother name will be easier

b) Kindly let me if a probate is done on any 1 beneficiary does that mean the other 3 beneficiaries forfeit their share towards the property by giving noc .

I would be grateful if you could answer both a & b

yes, in case the probate is done in one of the beneficiaries name, the other three must forfeit their share in her name. as far as condition in point a is concerned, such a condition is valid.
