Legal Question in Real Estate Law in India
To Rajiv: Follow up: The property was purchased by my father now deceased. we are two brothers, the younger one did not marry. He lives in India. I am worried what will happen to the property if we both pass away (76 and 74 of age). The property is in my father and mother name (both deceased).
Since, i and my daughters and wife are in the US, we don't have title papers either. how can the property be disposed off while we two brothers are living and after we pass away.
Issues involved are: title certification, succession and authenticatin of my daughters claim on the property and my brothers bank accounts in case of our death. The property is in Amabala city, Haryana.
How much time would it take to resolve the issue? do you take the cases in Ambala city? How much it would cost?

Dear Mr. Sohan
in this situation, a petition for succession needs to be filed on behalf of your daughters and you need to relinquish your share in favour of your daughters. neither you, nor your daughters need to visit india for this purpose and the petition can be filed in case you execute a power of attorney in favour of any relative of yours and/or your lawyer duly notarized by notary public in US.
