Real estate and property law

I became a Member of a Cooperative Group Housing Society, by virtue of the flat being mutated in my name. Can I now purchase a flat in the same Society in my wife's name separately? Will she be allowed to become a Member separately? Please guide.

As per Income-Tax laws, wife is an independent entity and is entitled to hold property in her name.

However, holding of property will depend upon State rules as also the bye-laws of your society.

You should consult the society bye-laws as also the Rules framed under State Cooperative Societies Act.

yes in the eyes of law husband and wife are seprate entity. she can purchase the flat in her name and can become the memeber of the society.

Most of the society restrict purchase of more than one flat by same family. Please check bye-laws of the society before purchase.
