Legal Question in Real Estate Law in India
Real Estate and Real Property law
A plot has been alloted to me by HUDA(cost Rs 19 lacs). During the payment of the 1st installment of Rs 3 lacs, a sum of Rs 40000/- had been contributed by my father in law and the rest of the money was given by me by taking loan from a bank.the plot has been alloted in my name. I now want to sell it to someone else but my Father in law is objecting to it and says that since he has also contributed some amount , I cannot sell it without his permission. pl tell whether i can sell the plot or not. if i return Rs 40000/- given by my father in law to him can it help me in anyway. No written agreement has ever been made between me and my father in law for the said plot and he is saying this to exert pressure on me not to sell the plot and build a house on it.

What is the problem in this matter?
The plot is owned by you and you can sell it your wish anytime.
There is no need to pay the money as well as there is no agreement being executed.
Re: Real Estate and Real Property law
This appears to be a transaction of temporary advance or hand loan advanced by your father-in-law to you. His claims are not tenable.

As per facts, its your plot and you can sell it anytime.
You dont have to even pay your father-in-law 40,000 as there is no agreement unless you want peace in family. Hope you got it.
