i have given my shop in pune on registered leave & license agreement for 3yrs ,now a bank has approached me for the same for thier requirement to put up an ATM, my first question is !) can i vacate my present tenant as per our agreement by giv ing him one months notice

2) what do i do if he even refuses even after the notice period

3 ) how long does it take to legally evict the tenant as the bank is in the hurry

You may try to settle the matter amicably with your tenant. The legal process, if initiated, may be costly and time consuming.

NORMALLY IT DEPENDS ON THE TERMS AND CONTIONS ON THE LEASE AGREEMENT. HOWEVER IF YOU FILE A CASE FOR EVICTION , IT MAY TAKE SEVERAL MONTHS

1. You can try.

2. Approach Court.

3. If tenant agrees to vacate, within couple of hours. If not, through court process minimum 2 years to any length of time may be required.
