Legal Question in Real Estate Law in India

Real Estate

I had purchased a flat along with my brother and his wife. The flat is in the names of all 3 of us. Now my brother has migrated to some other country and he wants to gift the flat to me. Can this be done without me having to pay the stamp duty on the flat again? I am from Mumbai, India

Re: Real Estate

Stamp duty can be saved. Your brother and his wife should execute relinquishment deed in your favour as it did not require regular stamp duty as in case of gift deed.

You have to pay stamp duty. However, it will at concessional rates so far as it pertains to your brother's share.
