Legal Question in Real Estate Law in India

real STATE

I m living in perantal ( since deceased), house openly, hostilely , continuously, uninteruptedly since last 20 years well 2 the knowlede of each & everybody. CAN I file a suit 4 declaration 4 ownership. Reply NOT w.r t. art. 65 BUT w.r.t. art. 64 & 113 of limitation act.I know that the plea of adverse possession is not possible but 2 do?

You will not be able to claim exclusive ownership of a family property to the exclusively of other family members who are co-owners.

The only way for you is mutual settlement or partition of property.

the theory of adverse possession doesnt apply in case of parent property and you need to show ur legal right over the said property depending upon the nature of property viz ancestral or self acquired.
