Legal Question in Real Estate Law in India
I recently bought a flat in Navi-Mumabi & applied for membership of society. society has recently been formed & has yet to make their byelaws. Now, society is demanding Rs. 25600/- for giving me various NOCs for cidco transfer & transferring the shares, though shares are yet to issued to the members of the society. Can society ask me the premium charges (in addition to transfer & entrance fee) in this situation of non-existing of any byelaws made or adopted by GBM of the society?

premium charges may be illegal. seek appropriate remedy before Registrar or local authority.

Check bye-laws of society and act accordingly.
Without bye-laws a society cannot come in existence.
