Legal Question in Real Estate Law in India
Registration of flat with the authorities
Dear Sir,
I am the flat purchaser in the year 1984 who have signed agreement for sale on stamp paper Rs.5/-. This transaction is after execution of conveyance in favour of society in the year 1975. I had not registered my flat document for conveyance and understood now that such document attracts SD because transaction is concluded in the year 1984 and such agreement is in effect as Sale deed. Therefore I have furnished application for the same with Stamp office in this Amnesty Scheme. I am awaiting demand notice for payment of SD. After this I would like to apply for registration, however I understand from your previous answers that registration is not possible after 8 months from the date of agreement. Does that mean I can not enter now my name in the record of rights with the authorities? or is it possible by giving deed of confirmation?

Re: Registration of flat with the authorities
Since entire property i.e. land and building is owned by society, your name will not be entered separately in the record and name of society alone will appear as owner.
In a society, member hold only right of occupation, use and enjoyment of flat and ownership vests with the society.
Re: Registration of flat with the authorities
You should approach the local authorities to ascertain the correct position.
