Legal Question in Real Estate Law in India

Registration & Stamp Duty

Agreement for Sale executed by me on Stamp paper Rs.5 with the seller in the year 1984 and possession taken by paying consideration amt.Rs.200,000. However that time docs. not executed for registration with registrar's office. Currently docs. submitted at stamp office for payment of duty on sale deed with proof of payments done in the year 1984. I have not yet received demand notice for payment of SD and therefore cannot proceed further with registration office. In such situation if I unable to pay SD prior to expiry of scheme and therefore unable to submit docs. for the registration office during scheme period, will it have any adverse effect or penalty on approaching the registration authority in future?

Re: Registration & Stamp Duty

Amnesty Scheme is not for the registration. It is only for stamp duty purposes.

Re: Registration & Stamp Duty

You should approach the Registrar's office and make payment within the stipulated period in order to avail the benefit of the scheme.

However, non-registration may not adversely affect your rights of ownership because you are in possession as de facto owner for the last more than twenty years.
