Legal Question in Real Estate Law in India
Relying on documents.
The plaintiff had filed a large number of documents in the beginning of the suit( TO RELY ON THEM DURING THE TRIAL) under the provisions of CPC. However, as the case proceded it was realised that many of the said documents were of no use for the support of his case. In fact they go against him & therfore has not been proved or got exhibited by him in the evidence led by him. Now, both the parties have closed their evidence & the suit is listed for arguments.Nevertheless, said documents remain on suit file. My uery is that whether the said documents could be read AGAINST the plaintiff when the defendant produce his Arguments in the suit irrespective of the fact that although the documents were filed by the pltff. yet were not proved by him?
