rental power of attorney

Hi, We want to rent out our property in a metro in india, it is a joint property between me and my wife , we both are out of country now .. which option should hold:

1. Somebody from india (parents) can develop a power of attorney and we both should sign it (after they come here for a short while)

2. One of us goes there develops power of attorney and gives it to parents to rent out - but it will have only one partners signature.

3. one partner should be there till the time he/she can get a tenant and fulfil all the formality of lease agreement with one owner signature

any other option please

You can execute a power of attorney before Consulate with photographs of persons giving power of attorney with photographs and signature of person receiving powers attested by you.

By this method you may not be required to travel to India as also your parents may not be required to travel abroad.

Dear Amol

you can execute a power of attorney in whichever country you are and then get the same notarized by notary public there and send the same to the person in whose favour the same is constituted. there is no need to visit india for this purpose. the person authorized would sign the lease deed on your behalf. better take help of a lawyer in preparing the deed.
