i have rented a commercial property

which rent is rs3620 per month from 1 april 2011 and i received rent for whole year in advance on 8 of april 2011 for the period of 1 april 2011 to 31 march 2012

may i file suit for eviction from tenant in september 2011 under section 106 transfer of property act

How could you file a petition for eviction in sept 2011when you have taken and accepted the rent for full one year. The answer is NO.

nothing can be opined unless a lawyer goes through the lease deed. in case there is a clause favouring you, you may file eviction proceedings.
