Legal Question in Real Estate Law in India

Respected Sir/Madam....

After my Father expired.....without any will....there was settlement deed among we bros and sisters......as Mom had expired long back.......Family settlement and Gift deeds duly stamped and registration done..........2 years back.....with each and every bros and sis sign in registrar office.......

Now suddenly we got notice from one of our sister.....after more than 2 years.....that she is not satisfied with settlement deed ....and has to un do it claiming that we others have done fraud and done jabardasti to her......

claimed many of criminality and what not on us......

can u pls advise how to get out of this.......!!

As nobody likes all this unnecessary disturbance in life.dat too in legal matters......where the notice and her claim is totally void.....I...being a widow.....from past 4 years......hav struggled a lot for more than 10 yrs now.....as My Husband was a not keeping well for 8 to 10 years and expired 4 yrs back.....now want to live my peaceful life with my Kids......

Pls requested to help me in this....

Dear ,

once the property has been divided you all should get the name changed ....

and after two years she claims that she is not satisfyed .... her claim wont stand ... as per time bound.... hope she also signed in front of registrar........

Dear Madam,

It all depends whether as per the settlement deed, were all financial claims duly settled amongst the brothers and sisters ? If yes, your sister cannot now say that she was coerced or forced to sign the papers. You need to ensure that the settlement in terms of monies to be paid is done to close the matter. Better still, I recommend you consult an advocate in Borivli, Chembur or Mulund to scrutinize all your papers and advice you accordingly.

Money, Property etc. are known causes of disturbance of peace and therefore, saints renounce all such things.

If you do not plan to renounce all such causes, then you have to live with same and also to fight appropriate legal battle in accordance with law.
