Legal Question in Real Estate Law in India

Rights on Father/Gradn father property

Dear Sir,

I would like to know what is the Indian law describes about the sharing of property in HUF.My grand father was having one brother and two wife and he had dived the entire property by 6 shares and he has given 3 of them in to his brother and 2 to my father and 1 share for him(since he was having 2 wife and my father is the 1st wife son). This entire property was not earned by him these are all the forefather property. My father had got 2 shares among that and he has one elder sister and she was married 1964 and this all settlements happened on 1984.After the death of my grand father my aunty has sent a notice to my father to give a share for her. This case is still running in the court but we hear from the advocate there wont be any chances since she got married before 1964 also now both of my grand father /mother passed away also we are not sure whether she has the proof that she is the daughter of my grand father. But my father and grand mother done all the things for my aunty & her childrens marriage but there is no proof for that and we completely away from my aunty family more than 11 years. Now I would like to know how this case will be in future as of now this is in the lower court (not a high court).

Re: Rights on Father/Gradn father property

Your aunt would be entitled to share in the property of your grandfather remaining with him after effecting partition. Infact, that share would be shared equally by all the heirs of your grandfather viz. mother, widows, sons, daughters etc.
