Legal Question in Real Estate Law in India
Is a Sale Agreement for a property mentioning the total amount, duration of leaving the said property etc made on plain paper between the buyer & seller in presence of two witnesses valid? The buyer has accepted a token amount during signing, however there is no mention of this token amount on the agreement? The seller is willing to return the token amount with interest if required.
Can such a deal be cancelled? Can the buyer pose any problems if this deal has to be cancelled?

Non mentioning of token amount may go in favor of seller as the token amount or bayana is the essence of a valid agreement. Read more on property issues on my website www.karvai.in.
May be valid.
May be cancelled.
There may be problems from the side of buyer.
The deal can be cancelled but buyer can create problem(s) which can be defended legally. Please check Sanjay Kalra and Associates on the internet to know more about our law firm and the kind of legal services we are rendering for our clients from all over the World.
