I would like to add more that case was filed only for permanent injunction to stop sale-purchase further by landlord becuase he already received advance amt Rs. 3 lacs and one room possession was also given by him at the time of BYANA (earnest money) but during the stay opp party settled by way odf compromise that he would execute sale deed aftere receipt full amt which was paid through court and recorded the statement in the court , sale deed was executed by him but he run away from the office of the Sub Registrar becuase his advocate was asking commission Rs. 3 lacs , opp party's advocate was his relative and you may be know him , any way I filed case before Sub Registrar and landlord was called through letter but he did not attend the proceeding , thereafter sub Registrar refused to register sale deed without presence of seller . We file appeal against order of Sub Registrar under section 72 of Registration Act which still pending with Registrar last 3 years . Sale deed was executed in Nov 2003 , Now we can file fresh suit under specific performance without waiting of order of Registrar , Secondly can we lodge FIR under section 420 and 406 IPC through 156 (iii) cr. pc
