Sale of Stilt Parking to member by Builder
Our building was registered under Maharashtra Co-operative Housing Society's Act, the builder has not yet given the conveyance deed, though it has almost 13 year passed the society is registered. Builder has sold stilt parking in our building�s society member. She was park her own car, & dumped her luggage & block this structure with collapse. Even society written police complaint & BMC Ward. But they are not taken any action against her. Because she has very close relation with local minister who is occupying the parking space due to which other society members are finding it difficult to use the parking space, we had passed resolution in our society requested these occupant to vacate the parking space, however there is no result. We had even filled case in High Court, the court judgment was demolish unauthorized structure. Please advice what action can be taken against builder & society member in this matter. Can we approach co-operative court under sec 91 of act.

file a criminal complaint before MM for fraud by the builder and make member a party also and by way of suit seek mandatory and permanent injunction for not parking her car in common place except on first come first basis
