Legal Question in Real Estate Law in India
Hi Sir, I have booked 2 bhk flat in Dream Valley project in noida extension on 11th march 2010 and now due to legal issues the project has not started yet. I have the sales agreement with me, As per the agreement they will send the demand letter of 30% of flat value. Now the project is not yet bankable and they have asked us to pay another 10%. when asked what will happen if we do not pay the 10% they say that they will apply the increased rate. My question is that is it legal for them to ask for 10% payment as the payment plan mentioned in agreement is 10% and then 30% and then 6 subsequent 10%. Please advise

you may seek refund of your money and in case they refuse to do so, you may approach the consumer forum. in case you want the flat despite it being dicey, you may have to follow the contract.
