Legal Question in Real Estate Law in India
Hello Sir, The building i reside in is being considered for redevelopment.
After several proposals given by many builders we are in discussion with one of the builder.
Our building has around 163 tenants residing currently.
There are 4 different sizes of rooms in the building:-
1. 180 sqft
2. 216 sqft
3. 235 sqft
4. 320 sqft
Now the proposal that the builder has given is that all the rooms below 250 sqft would get 300 sqft carpet area and 100 sqft as flower bed.
According to him this is a MHADA rule that has to be followed.
I understand this proposal for 180 sqft area but i am not ok with the same rule being applied for 216 sqft and 235sqft.
As we pay more rent,maintenance,stamp duty etc than the 180 sqft occupant.
I would like to know where can i find the exact details for this rule (if you can provide a doc or pdf it would be great).
Also the builder also states that the FSI of the building has already being used for our building.
More Details:-
Building being reconstructed in 1992 by demolishing a chawl as a redevelopment.
Area - Lower Parel.
Building is a Housing Society maintained by the tenants itself.
Current Redevelopment being done through Incentive Plan.
