Legal Question in Real Estate Law in India

Sir,

There was a draw for Huda sectors in faridabad in the year 2007.My husband applied on my name.Luckily we got the plot in my name. My husband is a U.D.C.He had no money to pay for the installments.My brother-in-law ( jeth ) who is well off offered to pay the installments.He told my husband to take the plot in his name and remove my name.My husband forced me to sign in his favour I was pregnant at that time.

I could not bear the physical and mental harrassment so i signed in his favour.I fear that my jeth can take that plot from him.My husband is not willing to listen nything from me he is doing what his brother says.We are financially very weak

and had only that plot with us.I do not want my husband either to sell that plot or

transfer it on anyone else name.

can i be a joint holder in that plot.

Kindly tell what legal action can i take to save that plot.

There is no occasion for you to keep any stress. Since you did not have the requisite money to deposit with HUDA as allotment price of the plot, you may better follow your husband's advice. A family settlement may be reached to make you owner to the extent of the value of "premium" over allotment price.

Legally, you are entitled not to transfer your rights in favour of any one but that in case you may have to either refuse to sign papers which may result in family dispute or you may have to take up the matter with HUDA.

Since it is more like a family dispute, it may be better to settle the matter amicably.

If you had released the plot in favour of brother of husband as per rules of HUDA, then difficult to claim the same back.

If it is still in your name, then you need not do anything.
