Legal Question in Real Estate Law in India

Hi Sir,

Good Morning.

I am not aware on the procedure to approach this.

Introducing Myself : I am Jai Prathop S working in Chennai. This email is on behalf of my mother Mrs Vijayalakhmi S. We have a case filed in High Court related to the Partition.

Doubt : I have question related to the Section 6 Hindu Amendment Act 2005.

Dispute : My grandpa, mothers father died on 2011. With this 'Section 6 Hindu Amendment Act 2005', will my mother get equal shares. Please advise.

Current situation : My mothers case is on the High Court , Chennai and on todays Sep17th 2012 hearing the Judgment is reserved. I was present on the hearing and the opponent lawyer, forced saying that this Section6 Hindu Amendment Act 2005 is not entitled to have equal shares when the mother's father died before 2005 i.e before passing this act.

Plea/Pray/Request : (1) Do a female child who born in our motherland has equal rights as like that of a son. Is the female child is treated as equally as a male child. Do we have laws for that. (2) Do our bench courts, civil courts, high courts and any courts for that matter, need to follow the present laws or they need to follow the same rules which were followed on olden days.

Please advise me on the above Dispute, Current situation and Plea/Pray.
