Legal Question in Real Estate Law in India
sir i would like to know if i am the nominee of the flat after my mothers death registered in the society ,but after my mothers death the will shows no share of mine in the flat my brother and sister have been given equal shares,for which my sister gave up her shares to be by making an affidavit,but now my brother is claiming half the share and now she also wants equal share,even though i am the nominee can they throw me out of my own house,or how can i go about because i cannot afford to pay both.

Nominee is merely a trustee of legal heirs of deceased.
If your mother bequeathed flat to your brother and sister, then they would be entitled to the flat.
Release or relinquishment by an affidavit is not legal.
