Legal Question in Real Estate Law in India
Sir, my paternal uncle, who is unmarried, wants to give his share of property to my brother. However this is hotly contested by his brother as he wants to have it for his children. Can my non married muslim uncle, adopt my brother now aged 29 Y & give him his share of land? If not how can he transfer his share of property to my brother? If he gives it as gift to my brother, can he gift the whole or only 1/3rd of the property? How can we overcome this problem?

There is no adoption in Muslim law ,your uncle can become a guardian of your brother provided he fulfils all the requirement of a Guardian under the Guardian and wards act. .Please check Sanjay Kalra and Associates on the internet to know more about our law firm and the legal services we are rendering for our clients all over the World.
