Legal Question in Real Estate Law in India

Sir i have possession of undivided property in my name. i have share of 2/3
and second party have 1/3 right.
i want to file a suit for partition
property is free hold
location is in rajouri garden new delhi
plot size is 45 by 60 sq yard
property is not constructed
value of registery is about 50 lacs
my query is
where suit can be filed in lower court or high court
what amount of court fee required to pay
as i and other party both have possessition
is court fee on percentage of registry i mean 4 to 6 percent of registry value
or normal court fee near around 1000 rs
or whether at time of degree i have to pay court fee or not

You need to pay the court fee as per your share. As per value, the case would be filed in high court and the court fee is 4%.
